DISH Network "Digital Home Plan" Disclaimer


Offer Terms

The Digital Home Plan or DishPVR Plan are for new, first-time DISH Network residential customers in the continental United States (only 1 per household), available from 2/01/03 through 7/31/03. All prices, packages and programming subject to change without notice. Local and state sales taxes may apply. Where applicable, receiver rental fees and programming are taxed separately. Social Security Number, valid major credit card and 12 consecutive month commitment required. Subject to credit approval. Social Security Numbers are used to obtain credit scores and will not be released to third parties except for verification and collection purposes only.

Activation Fee includes:

Customer must pay a $49.99 Activation Fee that includes installation and activation of up to four receivers and that is completely nonrefundable once the system is activated. Customer will receive a $49.99 credit on the first bill.

Digital Home Plan (DishPVR Plan) includes:

The Digital Home Plan includes 1 Model Dish301 satellite TV system, your choice of America's Top 150, America's Top 100, America's Top 50, DISH Latino Max or DISH Latino Dos programming, Standard Professional Installation and In-Home Service Plan; the DishPVR Plan includes 1 Model DishPVR satellite TV system. There is a one-time Equipment Upgrade Fee for the DishPVR Plan.

Equipment and Installation

Up to 3 additional receivers may be added for $5.00 per month each. Standard Professional Installation includes installation of one 20" dish antenna, hook-up of up to 4 receivers to the same number of TVs and equipment testing. Other installation restrictions apply and more complex installations may require additional fees.

Termination of Service

If programming is disconnected or downgraded below America's Top 50 for any reason, or if customer chooses to end Digital Home Plan before expiration of required 12-month commitment, customer will be charged a $240 Cancellation Fee within ten days of disconnection for early termination of services contract. All DISH Network equipment must be returned within fifteen days of account deactivation to DISH Network or customer must pay an Equipment Replacement Fee (Dish301 - $199, DishPVR - $399, DISH 500 LNBF - $50, Quad LNBF - $149). After the 12-month commitment expires, customer has the option of continuing on a month-to-month basis at the current monthly rate of any Digital Home Plan or returning the hardware with no penalty.

Fees and Credit

Any applicable fees will automatically be charged to the credit card provided to DISH Network and/or any other credit or debit card numbers that have been used to make payments to DISH Network. Customer authorizes DISH Network to investigate creditworthiness. Customer further authorizes DISH Network to report any payment defaults to credit reporting agencies. Customer acknowledges and agrees that DISH Network is not extending credit and that the Cancellation and Equipment Fees are not interest, a credit service fee or a finance charge.

Change of Service Fees

There is a $5.00 Change of Service Fee for each programming downgrade or change to same level of programming and a $10.00 Change of Service Fee for each Adult programming downgrade or change to same level of programming.

Programming

Local Broadcast Networks by satellite are only available to customers who reside in the specified local Designated Market Area (DMA). Certain local channels may require an additional dish antenna from DISH Network, installed free of any charges. Distant Broadcast Networks packages by satellite are only available for private home viewing and in limited areas, to homes that are located outside a Grade A or B designated area or with the approval of local affiliates. Local Broadcast Networks and/or Distant Broadcast Networks are available at an additional charge for those who qualify. All receivers must be connected to a phone line. ESPN and ESPN2 programming subject to change and blackout restrictions, and is licensed separately for residential and commercial use. Some games telecast locally may also be included in ESPN packages. FOX Sports Networks programming subject to blackout restrictions and licensed for residential use only. Regional sports networks and Turner South not available in all areas.

DISH Network shall determine eligibility for this offer in its sole and absolute discretion.
